Terms of Service

1. Acceptance of Terms

By accessing or using Indie Command Center ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, you may not access or use the Service. We reserve the right to modify these Terms at any time. Your continued use of the Service following any changes constitutes acceptance of the revised Terms.

2. Description of Service

Indie Command Center is a web-based productivity platform designed for indie hackers and solo developers. The Service provides project management, task tracking, idea capture, resource bookmarking, and daily progress tracking tools. The Service also includes social features and companion tools:

• Public build profiles accessible at /u/username
• Follow/unfollow system to connect with other builders
• Private profiles with follow request approval
• Global user search to discover other indie hackers
• Verified badges for notable builders, granted at our discretion
• A companion Chrome Extension for quick capture and account integration

The Service is provided "as is" and we may modify, suspend, or discontinue any part of it at any time.

3. Account Registration

To use the Service, you must create an account. You may sign in using your GitHub account via OAuth, or register with an email address and password. By creating an account, you:

• Confirm that any information you provide is accurate and complete.
• Accept responsibility for all activity under your account.
• Agree to keep your credentials secure and not share them with others.
• If using GitHub OAuth, authorize us to access your GitHub profile information (name, email, avatar).

4. User Content

You retain ownership of all content you create within the Service, including projects, tasks, ideas, resources, and progress entries ("User Content"). By using the Service, you grant us a limited license to store, process, and display your User Content solely for the purpose of operating and providing the Service.

Your profile information (username, bio, avatar) may be visible to other users on the platform if your profile is set to public. You control your profile visibility via the Private Profile toggle in your account settings.

You agree not to upload or create content that:

• Violates any applicable law or regulation.
• Infringes the intellectual property rights of any third party.
• Contains malicious code, viruses, or harmful data.
• Is abusive, harassing, defamatory, or otherwise objectionable.

5. Acceptable Use

You agree not to:

• Attempt to gain unauthorized access to the Service or its related systems.
• Use the Service for any illegal or unauthorized purpose.
• Interfere with or disrupt the integrity or performance of the Service.
• Reverse-engineer, decompile, or attempt to extract the source code of the Service.
• Use automated systems (bots, scrapers) to access the Service without permission.
• Resell, sublicense, or redistribute the Service without our written consent.

5b. Chrome Extension

Indie CMD offers a companion Chrome Extension. By installing and using the Extension, you agree that it may interact with your Indie CMD account using a secure token generated in your account settings. We do not collect browsing history or any data outside of the Indie CMD platform through the Extension. The Extension only transmits data you explicitly submit to the Service.

6. Data & Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your data. Your data is stored in a Neon managed PostgreSQL database and the application is hosted on Vercel. Both providers employ industry-standard security and encryption practices.

7. Intellectual Property

The Service, including its design, code, branding, logos, and documentation, is the intellectual property of Indie Command Center and is protected by applicable intellectual property laws. Nothing in these Terms grants you any right to use our trademarks, logos, or branding without prior written consent.

8. Termination

We reserve the right to suspend or terminate your access to the Service at our sole discretion, with or without notice, for conduct that we determine violates these Terms or is otherwise harmful to the Service or other users. Upon termination, your right to use the Service ceases immediately. You may request deletion of your account and data by contacting us.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL INDIE COMMAND CENTER, ITS OPERATORS, OR CONTRIBUTORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, REGARDLESS OF THE THEORY OF LIABILITY.

11. Indemnification

You agree to indemnify and hold harmless Indie Command Center and its operators from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

12. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved through good-faith negotiation, and if necessary, binding arbitration.
